Terms of Use
These Terms of Use ("Terms") govern your use of the Windō mobile application ("Windō", "the App"), provided by FBNZ Services Limited, trading as FBNZ Solutions ("we", "us", "our"), a company registered in New Zealand.
By downloading, accessing, or using Windō, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the App.
1. Description of Service
Windō is a fasting timer, (in future updates) body measurement tracker, and nutrition tracking application. Windō is a personal wellness tool intended to help you track your own fasting schedule, body measurements, and related health metrics that you choose to enter.
2. Not Medical Advice
Windō is not a medical device and does not provide medical advice, diagnosis, or treatment. The information, stages, and content provided within the App (including fasting stage descriptions) are for general informational purposes only.
You should consult a qualified healthcare professional before beginning any fasting regimen, particularly if you have any pre-existing medical condition, are pregnant or breastfeeding, are under 18, or are taking medication. Fasting is not appropriate for everyone. Use of Windō is entirely at your own risk.
3. Eligibility
You must be at least 13 years old to use Windō. If you are under the age of majority in your jurisdiction, you should only use Windō with the involvement of a parent or guardian.
4. Your Data
Windō stores the data you enter (fasting history, body measurements, profile information, and preferences) locally on your device only. We do not operate a backend server and do not collect, transmit, or store your personal health data on our systems. See our Privacy Policy for full details.
Because your data is stored locally, you are responsible for your own backups. Uninstalling the App, clearing app data, or switching devices without a backup will result in permanent loss of your data. We are not responsible for any data loss.
5. Subscriptions (Pro Tier)
Windō may offer optional paid subscription features ("Pro") in the future, processed through Google Play's billing system and/or RevenueCat. Where applicable, pricing, billing frequency, and cancellation terms will be presented to you at the point of purchase and are also governed by Google Play's terms of service.
6. Acceptable Use
You agree not to misuse the App, including attempting to reverse-engineer, decompile, or interfere with its normal operation, or use it for any unlawful purpose.
7. Disclaimer of Warranties
Windō is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.
8. Limitation of Liability
To the maximum extent permitted by law, FBNZ Services Limited shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising from or related to your use of the App, including any health outcomes resulting from fasting practices undertaken using information from the App.
9. Changes to the App and These Terms
We may update, modify, or discontinue features of the App at any time. We may also revise these Terms from time to time; material changes will be reflected by an updated "Last updated" date, and continued use of the App after changes constitutes acceptance of the revised Terms.
10. Governing Law
These Terms are governed by the laws of New Zealand, without regard to conflict of law principles.
